IMPORTANT – PLEASE READ CAREFULLY: These Terms of Service ("Terms") constitute a legally binding agreement between you (the "user" or "you") and the developer of the mobile application "Elfins's Water Sort Puzzles" ("Licensor", "we", "us", or "our"). By downloading, installing, accessing, or using the Application, you agree to be bound by these Terms. If you do not agree, do not download, install, access, or use the Application.

1. Eligibility

By using the Application, you represent and warrant that:

You have the full legal capacity to accept these Terms;
You are not located in a country subject to an embargo or designated as supporting terrorism.

2. Third-Party Accounts

The Application itself does not provide or require a built-in user account system. However, the Application may offer integration with third-party platforms (such as Apple Game Center on iOS and Google Play Games Services on Android) for features such as leaderboards, achievements, and social features. Any use of such third-party services is subject to the respective terms of service and privacy policies of those third parties. We are not responsible for the practices of these third-party platforms.

3. License and Use Restrictions

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Application for your personal, non-commercial entertainment purposes only, subject to these Terms.

You agree not to:

Sell, rent, lease, redistribute, sublicense, or commercially exploit the Application or any portion thereof;
Copy or use the Application for any purpose other than personal, non-commercial use;
Modify, adapt, translate, decrypt, reverse compile, disassemble, or reverse engineer the Application, or attempt to derive its source code;
Remove, alter, or obscure any copyright, trademark, or other proprietary notices within the Application;
Circumvent any security or digital rights management mechanisms in the Application;
Use the Application for any illegal, fraudulent, or unauthorized purpose.

4. In-App Purchases

The Application offers in-app purchases of virtual goods, items, or services through one-time payments ("Purchases"). The following terms apply:

Payment — All Purchases are processed by the Apple App Store or Google Play Store (the "App Stores"). We do not process or store any payment information.
No Refunds — All Purchases are final and non-refundable, except as required by applicable law. Refund requests must be directed to the relevant App Store in accordance with its refund policy.
No Real-World Value — Virtual items purchased within the Application have no real-world monetary value and may not be exchanged for cash, real goods, or services outside the Application.
Modification of Items — We reserve the right to modify, adjust, or discontinue any virtual items or pricing at any time with reasonable notice where required by applicable law.
Third-Party Terms — Your payment relationship is governed by the terms of the applicable App Store. By making a Purchase, you agree to the App Store's terms.
Restore Purchases — If you reinstall the Application or switch devices, your previously purchased items may be restored through the relevant App Store's restore mechanism.

5. Promotions, Contests, and Sweepstakes

We may, from time to time, offer promotions, contests, sweepstakes, or other special events ("Promotions"). Any such Promotions are governed by these Terms unless separate official rules are published. When separate rules are provided, those rules shall govern that Promotion. We reserve the right to modify, suspend, or cancel any Promotion at any time without prior notice, to the extent permitted by applicable law.

6. Feedback and Suggestions

We welcome your feedback, suggestions, ideas, or proposals regarding the Application ("Feedback"). By submitting Feedback, you grant us a perpetual, irrevocable, worldwide, royalty-free, fully paid-up license to use, reproduce, modify, adapt, publish, distribute, and incorporate such Feedback into the Application or any other products or services, without any obligation of compensation, attribution, or credit to you. You agree that no Feedback you provide will violate any third-party rights.

7. Intellectual Property

The Application, including its code, design, graphics, animations, audio, visual elements, user interface, artwork, game mechanics, and all related content (collectively, the "Content"), is owned by or licensed to us and is protected by applicable intellectual property laws. No title or ownership of the Application or any of its Content is transferred to you under these Terms. All rights not expressly granted under these Terms are reserved.

8. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR AVAILABILITY. WE DO NOT WARRANT THAT THE APPLICATION WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS. USE OF THE APPLICATION IS AT YOUR SOLE RISK.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OR INABILITY TO USE THE APPLICATION, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, LOSS OF GOODWILL, DEVICE DAMAGE, OR BUSINESS INTERRUPTION, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

10. Termination

We reserve the right to terminate or suspend your access to the Application at any time, without prior notice or liability, if you violate these Terms or for any other reason. Upon termination:

All rights granted to you under these Terms shall immediately cease;
You must cease all use of the Application and delete all copies from your devices.

Sections 6 (Feedback), 7 (Intellectual Property), 8 (Disclaimers), 9 (Limitation of Liability), and 13 (Governing Law) shall survive any termination.

11. Changes to These Terms

We may revise these Terms from time to time. When we make material changes, we will notify you through the Application or by other reasonable means (e.g., an in-app notice requiring your acknowledgement). Your continued use of the Application after the effective date of such changes constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Application.

12. Third-Party Services and Links

The Application may include links or integrations with third-party websites, services, or platforms (including but not limited to Apple Game Center, Google Play Games Services, and social media platforms). We are not responsible for the content, privacy practices, or terms of any third-party services. Your use of such third-party services is at your own risk and is governed by their respective terms and policies.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the People's Republic of China. Any disputes arising out of or in connection with these Terms shall first be resolved through friendly negotiation. If negotiation fails, either party may submit the dispute to the competent court in the location where the Licensor is domiciled.
