End User License Agreement (EULA)

IMPORTANT – PLEASE READ CAREFULLY: This End User License Agreement ("EULA") is a legal agreement between you (either an individual or a single entity) and the developer ("Licensor", "we", "us", or "our") for the mobile application "Elfins's Water Sort Puzzles" (the "Application"). By downloading, installing, accessing, or using the Application, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not download, install, access, or use the Application.

1. License Grant

Subject to the terms and conditions of this EULA, the Licensor grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the Application on devices that you own or control, solely for your personal, non-commercial entertainment purposes.

2. License Restrictions

You agree that you will NOT:

Commercial Use — Sell, transmit, host, rent, lease, lend, redistribute, sublicense, or otherwise commercially exploit the Application or any portion thereof;
Copying — Copy, reproduce, duplicate, or use the Application for any purpose other than personal, non-commercial use;
Modification & Reverse Engineering — Modify, adapt, translate, decrypt, reverse compile, disassemble, or reverse engineer the Application, or attempt to derive the source code of the Application, in whole or in part;
Remove Notices — Remove, alter, or obscure any copyright, trademark, or other proprietary rights notices appearing on or in the Application;
Unauthorized Access — Bypass, disable, or circumvent any security features, encryption, or digital rights management mechanisms in the Application;
Violation of Law — Use the Application for any illegal, fraudulent, or unauthorized purpose, or in violation of any applicable laws or regulations.

3. Intellectual Property Rights

The Application, including but not limited to its code, design, graphics, animations, audio, visual elements, user interface, artwork, characters, game mechanics, and all related intellectual property rights, are and shall remain the exclusive property of the Licensor. The Application is protected by copyright, trademark, and other intellectual property laws of the People's Republic of China and international treaties. No ownership or proprietary interest in the Application is transferred to you under this EULA.

4. Updates and Modifications

The Licensor may, from time to time and at its sole discretion, release updates, patches, bug fixes, new features, or other modifications to the Application ("Updates"). This EULA will govern any and all Updates provided by the Licensor, unless such Updates are accompanied by a separate license agreement, in which case that separate agreement shall govern. The Licensor reserves the right to modify, suspend, or discontinue any aspect of the Application at any time without prior notice or liability.

5. Feedback and Suggestions

If you provide the Licensor with any feedback, suggestions, comments, ideas, or proposals regarding the Application ("Feedback"), you hereby grant the Licensor a perpetual, irrevocable, worldwide, royalty-free, fully paid-up, and sublicensable license to use, reproduce, modify, adapt, publish, distribute, and incorporate such Feedback into the Application or any other products or services without any obligation of compensation, attribution, or credit to you.

6. Privacy

The Application does not collect, store, or process any personal information from its users. However, please note that the Apple App Store and Google Play Store (the "App Stores") may collect certain information in accordance with their own privacy policies. The Licensor is not responsible for the data collection practices of the App Stores. If the Licensor changes this practice in the future, an updated privacy notice will be provided.

7. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR AVAILABILITY. THE LICENSOR DOES NOT WARRANT THAT THE APPLICATION WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS. YOU USE THE APPLICATION AT YOUR OWN SOLE RISK.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE LICENSOR BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE USE OR INABILITY TO USE THE APPLICATION, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, LOSS OF GOODWILL, DEVICE DAMAGE, OR BUSINESS INTERRUPTION, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF THE LICENSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

9. Indemnification

You agree to indemnify, defend, and hold harmless the Licensor from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your breach of this EULA or your violation of any applicable law or regulation.

10. Termination

This EULA is effective until terminated. Your rights under this EULA will terminate automatically without notice from the Licensor if you fail to comply with any term of this EULA. Upon termination, you must cease all use of the Application and delete all copies of the Application from your devices. The Licensor also reserves the right to terminate or suspend your access to the Application at any time, without prior notice or liability, for any reason whatsoever.

11. Governing Law and Dispute Resolution

This EULA shall be governed by and construed in accordance with the laws of the People's Republic of China. Any disputes arising out of or in connection with this EULA shall first be resolved through friendly negotiation. If negotiation fails, either party may submit the dispute to the competent court in the location where the Licensor is domiciled.

12. Severability

If any provision of this EULA is held to be invalid, illegal, or unenforceable under applicable law, the remaining provisions shall continue in full force and effect. The invalid, illegal, or unenforceable provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable while preserving its intent.

13. Entire Agreement

This EULA constitutes the entire agreement between you and the Licensor regarding the use of the Application and supersedes all prior or contemporaneous understandings, agreements, and communications, whether written or oral, relating to the subject matter hereof.

14. App Store Acknowledgment

To the extent this Application is made available to you through the Apple App Store or Google Play Store (each an "App Store Provider"), the following terms apply:

No Party Status — This EULA is between you and the Licensor only, not with any App Store Provider. The App Store Provider is not a party to this EULA and has no obligation whatsoever with respect to the Application.
Responsibility — The Licensor, not the App Store Provider, is solely responsible for the Application and its content, maintenance, support, and any warranties or liability claims related thereto.
No Support Obligation — The App Store Provider has no obligation to furnish any maintenance or support services with respect to the Application.
Claims — In the event of any third-party claim that the Application or your possession and use of the Application infringes that third party's intellectual property rights, the App Store Provider shall not be responsible for the investigation, defense, settlement, or discharge of such claim.
Compliance — You represent and warrant that: (a) you are not located in a country subject to a U.S. government embargo or that has been designated by the U.S. government as a "terrorist supporting" country; and (b) you are not listed on any U.S. government list of prohibited or restricted parties.
Apple App Store Specific — If you access the Application through the Apple App Store, you may also use the Application on any Apple-branded device you own or control, as permitted by Apple's Usage Rules. Apple and Apple's subsidiaries are third-party beneficiaries of this EULA. Upon your acceptance of this EULA, Apple will have the right to enforce this EULA against you as a third-party beneficiary.
Google Play Store Specific — If you access the Application through Google Play Store, you acknowledge that Google Inc. and its affiliates are third-party beneficiaries of this EULA. Google may enforce this EULA against you.
